1. Who we are

This online store ("Store") is operated by Pharmacose Music, LLC ("we", "us", "our"). It sells merchandise for Pharmacose and the Ascension's Constraint project. By using the Store or buying from it, you agree to these Terms, our Refund policy, our Shipping policy and our Privacy policy. If you do not agree, please do not use the Store.

2. Eligibility

To place an order, you must be at least 18 years old, or the age of majority where you live, or have the permission of a parent or guardian. You agree to give accurate information when you order.

3. Where we sell

We sell and ship to the United States and to the other countries offered at checkout. See our Shipping policy.

4. Made to order

Items are printed on demand by third-party production partners after you order. Orders can be cancelled for a full refund within 2 hours of being placed. Production and delivery times are estimates. Once production has started, an order may not be cancellable. See our Refund policy for cancellations, returns and refunds.

5. Product images and colour

Product photos are digital mockups. Printed colours, print placement and print size can differ slightly from what you see on screen, and from one item to the next. Garment sizes can vary within the tolerance shown in each size guide. These normal differences are not defects.

6. Prices and payment

Prices are in US dollars. Sales tax, where it applies, and shipping are added at checkout. Payments are processed through Shopify's checkout and its payment providers. We do not store your full card details. We can change prices at any time, but a change will not affect an order we have already confirmed.

7. Orders, errors and availability

Your order confirmation email means we have received your order. It does not mean we have accepted it. We can refuse or cancel an order, for example when a price or product listing contains an error, when an item becomes unavailable, or when we suspect fraud. If we cancel an order you have paid for, we will refund you in full. We try to keep listings accurate, but we do not guarantee that every description, price or image is error-free.

8. Our artwork and brand

All designs, artwork, logos, names (including "Pharmacose" and "Ascension's Constraint"), text and images in the Store belong to Pharmacose Music, LLC or its licensors. Buying a product lets you own and use that physical item. It does not give you any right to copy, reproduce, resell as your own design, or otherwise use the artwork or brand.

9. Acceptable use

You agree not to use the Store for anything unlawful, not to try to disrupt or gain unauthorised access to it, and not to scrape, copy or resell its content. If you send us messages, reviews or other content, you confirm that you have the right to share it and that it is not unlawful or abusive.

10. Third-party services

The Store runs on Shopify, and orders are produced and shipped by third parties. Your use of their services may also be covered by their own terms. We are not responsible for third-party websites that we link to.

11. Disclaimer

Apart from what our Refund policy states and what the law requires, the Store and its products are provided "as is" and "as available". To the fullest extent the law allows, we make no other promises, whether express or implied.

12. Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental or consequential loss arising from your use of the Store or its products. Our total liability for any claim about an order is limited to the amount you paid for that order. Nothing in these Terms limits liability that cannot be limited by law.

13. Indemnity

You agree to cover our reasonable losses and costs if a claim is made against us because you broke these Terms or the law.

14. Governing law

These Terms are governed by the laws of the State of Tennessee and applicable US federal law, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Tennessee, unless the law where you live gives you the right to bring a claim elsewhere.

15. Changes

We may update these Terms from time to time. The version posted here, with its "Last updated" date, applies to orders placed after that date.
